Nothing legally binding to sell on ebay, if they refuse to sell, the worse thing that can happen is getting negative feedback, or send money back if the buyer sends money. The only way he gets out of it, if the seller and winner have a understanding, but since he mentions in the posting about a possible reserve price, not sure how that will play out A few months ago, someone was selling a Nissan GTR, but failed to put a reserve price on the car, the bidder won it for $55,000, so when the auction ended the winning bidder contacted the seller saying "how do you want me to pay" the seller said he is not going to get the car unless he coughed up a few grand more. The winning bidder contacted ebay about the winning price and mentioned the seller said it wouldnt sell it. They were not forced, Not really legally binding, nothing signed. Now if money changes hands, that's a different story. This is all Ebay can really do per the user agreement as stated in the article: We are reaching out to the dealer to confirm what happened. If the buyer's story is accurate, this behavior is in direct violation of the eBay User agreement. Specifically, the Seller has: 1) Failed to deliver items purchased 2) Attempted to manipulate the price of the item The eBay Dealer team will contact the Seller immediately and if warranted notify them of their violation of the user agreement. Just like eBay can NOT force a bidder to pay for an item they were high bidder on. Anyone that thinks otherwise just doesn't know the reality of eBay.
