MRGEORGE
------------------------------------------------------------ Editor's Note: The original topic from 28 Sept. was moved into a non-readable section, which is not an action that Shelby American approved. Another topic appeared, which we then merged with the original topic. Thus, this post contains two merged topics. We apologize that the topic was hidden from public view. As soon this was discovered, it was restored. Nothing from the below press release has been altered. Shelby's response to this can be found on post #15. Robert Lane ------------------------------------------------------------ PRESS RELEASE SHELBY AUTOMOBILES SUED FOR BREACH OF CONTRACT, BAD FAITH, FRAUD, NEGLIGENCE, AND CONVERSION Los Angeles, California (September 19, 2012)- Stephen Becker Automotive Group, Inc. has filed suit in Los Angeles Superior Court against Shelby Automobiles, Inc., a subsidiary of Carroll Shelby International, Inc. Stephen Becker Automotive Group alleges in its complaint that Shelby Automobiles defrauded it by inducing it to enter into a Cobra dealership agreement and then, when the dealership invested its capital and ordered several Cobras, pocketing the dealership’s money. Stephen Becker Automotive company spent hundreds of thousands of dollars for high-ticket Cobra vehicles, but Shelby Automobiles shelved the orders and did not produce the ordered vehicles for years, and in some cases not at all. Stephen Becker Automotive also alleges that Shelby Automobiles then tried to force it out of business so that Shelby Automotive could sell the ordered vehicles to other parties for even more money. The Law Offices of Michael A. Brewer filed the lawsuit on behalf of Stephen Becker Automotive. They can be reached at 2020 Main Street, Suite 900, Irvine, CA 92614, or at (949) 679-6060
clark17357
Becker is the Planet Cobra guy, right? Didn't he and Shelby sign a 5 year deal mid year 2011? It would be interesting to see a copy of the Complaint that was filed to see what the specific allegations are. Anyone have a copy? Jim Edit: Poor sentence structure. ageishecker
Since you've posted this on multiple forums, and in at least case as your first post to that forum, I have to assume you have a personal vendatta against either SAI or Stephen Becker, or maybe both. Is Becker by chance the dealer you've been complaining about on Club Cobra? If this is personal why don't you take it somewhere else.

Staff
Official Shelby Response "The press release issued by Planet Cobra is a libelous document issued by a dealer who entered into a dealer agreement with Shelby American over four years ago and made substantial profits on orders for Cobra vehicles. Now unfortunately he finds it necessary to sue after Shelby demanded payment on past due invoices. In 2010, Carroll Shelby personally made a substantial personal loan to Mr. Steven Becker, the owner of Planet Cobra, to help him meet his financial obligations. If Mr. Shelby were alive today, he would be terribly disappointed with Mr. Becker. Shelby American will vigorously defend the fictitious claims set forth in Planet Cobra's press release and lawsuit, which reads like it came from a different planet." 2010KonaBlueGT
We're not going to close down discussion. Nor do I think you should shut it down. Kudos to you, Robert. Like someone else said, most companies would just remain silent and let the rumors fly. Personally I wouldn't have a problem with you guys (Shelby American) remaining silent because I know from experience, "Anything you say WILL be used against you in a Court of law"...Which is exactly why many/most don't comment on pending litigation. And IMO, just because a thread/comment isn't complimentary/flattering towards Carroll Shelby and/or Shelby American (or any employee thereof), it should not be shut down. That will only get you roasted and toasted for being a overly 'censored' site and give the 'air of appearance' of guilt. Frankly, a couple of the posts in this thread remind me of the story where the little kid points out that the King is naked..."HOW DARE YOU SAY SOMETHING BAD ABOUT SHELBY!" (i.e. say, "The King Is Naked" out loud). Most call those kind of people "Fanboys", and that's not typically looked at as flattering or as a term of endearment. Best, George George, you said that "There is nothing wrong with being informed" but you only gave 1 piece of a side of the information. At the time of my original post, the only information available was a public press release put out by Becker. Subsequently, Shelby American has posted their position not only on this site but in other public forums, which was the proper and correct thing for them to do .I also believe they presented their position very well. Since that time there has been additional information provided the public which is as follows: http://www.autonews.com/apps/pbcs.dll/article?AID=/20120928/RETAIL07/120929859/dealer-sues-shelby-alleges-pocketed-payments-for-unbuilt-cars http://www.autoweek.com/article/20120928/CARNEWS/120929798 http://www.nationalspeedsportnews.com/more/becker-automotive-sues-shelby-automobiles/ And for the lawyers out there: http://www.autonews.com/assets/PDF/CA83053928.PDF You are correct that before an informed decision can be made not only do you have to have all of the facts and all the pertinent information but in this case we will all have to wait for the ultimate decision of the courts. Yeah, we've noticed. You're blasting this spam everywhere. So far you've missed two of the 10 or so car forums I frequent. Gotta dig deeper to make sure you hit all of them. So precisely what horse do you have in this race? I bought and sold a Shelby CSX. I bought it because I loved it and sold it because my wife hated it. But you seem to have a burr under your saddle. Come clean. Right now you're heading to the top of people I truly hope I never meet. Don't worry, we'll never be friends.

stephen_becker
Just to let everyone know that I really appreciate the many, many phone calls and e-mails showing overwhelming support for myself and my dealership in reference to this on-going litigation with Shelby American Inc – Thank you! I also want to make it very clear that my PR team will very soon be putting together a website that can be accessed by all interested in this litigation to not only have access to read the original complaint but to also read SAI's rebuttal, review any and all filings (from both sides) with the court and to review the videos and written transcripts of the depositions that will take place as this case progresses - I am 100% transparent in both my personal and professional life so as to not skew anyone by not showing everything that is happening with both the plaintiff & the defendant.
