I rented one of these for a couple of days earlier this seasion and I was interested to see how Hertz contract addresses things like this (I did not race mine). I thought some of you might like to see the actual verbaige in the Hertz contract relating to such activities

 

From the Hertz rental agreement:

 

5. PROHIBITED USE OF THE CAR

Neither you nor any authorized operator may:

b. Intentionally destroy, damage or aid in the theft of the car

d. Engage in any willful, wanton or reckless misconduct;

e. Use or permit the use of the car by anyone:

4) in a speed test or contest

 

Most of the contract appears to be around Hertz insurance being void in such circumstances. I does not appear to address any potential penalties imposed against the renter when it can be proven that this occurs. I am not a laywer so I am unsure if Hertz could fine or sue if they can prove willful mistreatment of one of these cars.
